久しぶりに Philosophy for Everyone（良い本ですので是非お読みください）に戻ってきました。第3章の執筆者はGuy Fletcher先生です。この先生にはThe Philosophy of Well-Beingという有名な「幸福論」の著作があり、まだ（たぶん）邦訳されていません。私も機会がありましたら読んでみたいと思っています。
さて、今回のテーマは「政治的な義務」、すなわち、Do we have an obligation to obey the law?「私たちは法律に従う義務があるのか？」です。「え、そんなの当り前じゃない。」と言って何も考えないのは、およそ哲学的態度とは言えません。
A more important issue for getting to grips with the problem of political obligation is coming to understand what it is to have an obligation to obey the law.
義務の有無を問う前に、そもそも「法律に従う義務をもつとはどのようなことか」が問われます。
哲学は何でも必ず語の定義からスタートしますね。
The key points here are, first, that obeying the law is not the same as complying with the law and, second, that having an obligation to obey the law is not the same as having an obligation to comply with the law.
「むむむっ！」て感じですよね。obeying the lawとcomplying with the lawが異なる概念であるとは！
（「訳せば同じ」という声が聞こえてきそうですね。）第１の問題と第２の問題を厳密に区別しているところも、なるほどなあという感じですね。
If in fact your taxes get paid then that is enough to count as complying with the law. The law told you to do something and you did it. Acting in accordance with the law is sufficient to comply with the law.
上記の違いを説明する例として、所得税の支払いの例が挙げられています。法に従って税を支払うだけで、complying with the lawであるには十分であるというのです。
By contrast, to obey that law you must act in accordance with the law … because it is the law. Thus if someone pays their income tax only because they do not want to be punished for not doing so then they have complied with the law. But they have not obeyed the law.
それに対し、obeying the lawは「それが法律であるがゆえに」税を払わなければならないのです。罰則を恐れて税を払うのではcomplying with the lawは満たしていても、obeying the lawではありません。ここに重要な相違が存在するのです。
ここでまた、Cambridge Dictionaryで調べてみましょう。
comply =to act according to an order, set of rules, or request:
obey=to act according to what you have been asked or ordered to do by someone in authority, or to behave according to a rule, law, or instruction:
ううむ、「権威から命じられたから従う」がobeyなのですね。わかったような、わからないような･･･ですね。
上記の２つは異なる概念ですので、それに従う義務の内容もまた異なってきます。
The difference between an obligation to comply with the law and an obligation to obey the law is important here because it is easy to have obligations to comply with the law.
We have obligations to comply with the law because of the effects of breaking those laws. （中略） These are clear cases of our having obligations to comply with the law.
comply with the lawの義務を持つことの方が、obey the lawの義務を持つことより簡単だと述べられています。なぜかというと「法に従わないと不利益が生じる」からです。それは嫌なので普通誰でも法律に従うのです。もう少し突っ込んだ言い方をしますと、「従わないとひどい目にあうから従うということは、法の精神とは無関係」だということでしょうか。
It is the obligation to obey the law that is central here to our investigation of the problem of political obligation. We have an obligation to obey the law if we have an obligation to act in accordance with the law because the law commands it.
ここで政治哲学で問題となるのは、obey the lawの方であることが表明されます。キーワードは「法が命じるから」です。「従わないと何か不利益が生じるから」ではありません。
だんだんわかってきましたね。最後に理解をさらに確かにする例が挙げられます。
Desert stop sign: You are driving through a remote stretch of desert. You see a stop sign at a junction up ahead. You are driving slowly and can clearly see that there are no other vehicles (or any people) for miles around. Nevertheless, the law requires that you stop your vehicle. You are deciding what you ought to do.
実は大学時代読書会で、哲学修士の人から同じ質問を投げかけられたことがあって、私も同じことを高校生に聞いてみたことがあるのです。ただし車ではなくて歩行者としての例でしたが。これが政治哲学のテーマだったとは知りませんでした。
この状況では、信号で止まらなければならないような私的な理由も、道徳的な理由もありません。また交通事故に巻き込まれるような危険もありません。また他人に見られる心配もありません。要するに法に従わなくとも罰せられる可能性は皆無の状況だと仮定します。
Despite thinking all of this, you nonetheless stop your car. Your passenger asks why you did so and you answer: ‘The law requires me to stop and I ought to obey the law.’
それにもかかわらず、あなたは車を止めます。なぜでしょうか？「法が命じるから」です。この「命じる」はいやおうなしに「命令する」という意味の「命じる」ではありません。
Now suppose that your fellow passenger asks: ‘Why do we have an obligation to obey the law?’ Now you are being asked for a solution to the problem of political obligation, a ground for the obligation to obey the law.
ここで同乗者があなたに尋ねます。「信号を守らなくても何の不利益も生じないのに、なぜ法律に従うのか？」と。
ここで問われているものこそ、最初に述べた「法に従う根拠」(Grounds)です。
The problem of political obligation is that of explaining why we have an obligation to obey the law. Even if we have an obligation to obey the law, this does not mean that that obligation is decisive, that it is what one must do.
ここでさすがに哲学らしい留保が付け加えられています。政治的義務の問題は、「なぜ私たちには法に従う義務があるのか」を説明することにあるのであって、義務に従って行動することを私たちに強制することではありません。obligationはmustではないのです。
私自身は、今の例でどうするかはわかりません。おそらく歩行者だったら、赤信号でも渡ってしまうと思います。車だと信号待ちするような気がします。いずれにしても、仮に法律にcomply withはしていても、obeyしてはいないのかもしれません。でもそれではだめで、obeyしなければいけない根拠は何なのでしょうか？この問題を次回扱いたいと思います。
皆が当たり前と感じ、問うこともしない事柄に疑問を投げかけていくことこそが、哲学的行為なのです。規則、約束事、法律を守る(obey)だけでなく、その根拠を問うこと。場合によると守らなくてもよい法律もあるのかもしれません。
